What Should a Rental Agreement Include?
A useful rental agreement identifies the parties and property and makes the practical terms clear. The exact legal form depends on where the property is and the tenancy type, so a generic document should never override mandatory housing law.
Parties and property
Identify the landlord, tenant or joint tenants, the rental property and the date occupation starts.
Rent and payment
State the rent, when it is due, how it is paid and the rental period. In England, most assured private tenancies are periodic under the post-1 May 2026 system.
Deposit and responsibilities
Record any deposit and clearly describe agreed responsibilities such as utilities, permitted use, care of the property and other lawful conditions. Separate statutory requirements may also apply to deposits and property safety.
Ending the arrangement
A template should not promise that a tenancy ends automatically on a date where the law says otherwise. In England, assured tenancies are rolling; Scotland uses open-ended private residential tenancies; Wales has its own occupation-contract system.

Housing law differs materially across England, Wales, Scotland and Northern Ireland. Check the current rules for the property before signing.
England rental agreements after 1 May 2026
For most private assured tenancies in England, the 2026 rules changed the structure of the tenancy. New assured tenancies are periodic rather than fixed-term agreements with an automatic end date. Landlords must also give tenants prescribed written information about key tenancy terms before the tenancy is agreed or the agreement is signed.
That makes details such as the parties, property, rent, rental period and other required tenancy information especially important. A document created from a general template should be checked against the current England requirements before it is signed.
Rental agreement checklist
Before signing, check that the document clearly records the landlord and tenant names, property address, start date, rent amount, when and how rent is paid, the rental period, any deposit, responsibility for bills and utilities, permitted use of the property, repair or care obligations, and any other terms that are lawful and relevant to the tenancy.
Also check whether separate documents or prescribed information must be supplied. The agreement itself is only one part of a landlord's legal responsibilities.
What should not be copied blindly from an old template?
Old tenancy templates can contain assumptions that no longer fit current law. In England, for example, a clause describing an assured tenancy as ending automatically on a fixed date may be misleading under the rules applying from 1 May 2026. References to possession procedures should also be checked against the current regime rather than copied from an older agreement.
What belongs in a simple residential rental agreement?
A short agreement still needs enough detail to prevent avoidable uncertainty. At minimum, make sure somebody reading it later can answer:
- Who are the landlord, tenant and any joint tenants?
- Which property or room is being rented, and when does occupation start?
- How much is the rent, what period does it cover, when is it due and how is it paid?
- What deposit was taken and how must it be protected or held?
- Which bills, services, furnishings and shared areas are included?
- What are each party’s responsibilities for repairs, care, access and reporting problems?
- What lawful notice or ending arrangements apply?
Keep the agreement and rent receipts together
The agreement records what should be paid; a rent receipt records what was actually received. For cash, part payments or any situation where the payment trail is not obvious, a receipt should identify the tenant, property, rental period, amount, date and payment method. Choose the right property document
A rental agreement records the landlord-and-tenant terms. A rental application presents a prospective tenant’s details before any agreement is offered. A rent receipt records a payment already made. A roommate agreement records practical expectations between people sharing a home, but does not replace their agreement with the landlord.
Questions to answer before signing
Check whether the letting is actually an assured periodic tenancy, a lodger arrangement, an occupation contract, a Scottish private residential tenancy or another type of agreement. Confirm whether licensing, deposit protection, safety documents, an inventory, prescribed written information or a specific form is required. A generic template cannot make those decisions for you.
